FMLA eligibility FAQ

This page expands the common questions that sit behind the LeaveCheck screener. It is written to make the first pass clearer, not to replace employer-specific advice.

Can I use FMLA if I work remotely?

Maybe, but remote employees still need a worksite analysis. The relevant site is often the office you report to or receive assignments from, not automatically your home address.

Do paid holidays or PTO count toward 1,250 hours worked?

The rule generally focuses on actual hours worked. Paid time that was not worked often does not count the same way, which is why LeaveCheck pushes uncertain users to confirm payroll records.

What if my 12 months of service were split up?

Non-consecutive service can still count depending on the facts. The checker marks that path as needing confirmation rather than pretending every break in service resets the clock.

Do public agencies and schools use the same 50-employee threshold?

No. Public agencies and elementary or secondary schools are generally covered under a different framing than private employers.

Does a routine cold or one-off appointment qualify?

Usually not. LeaveCheck separates common serious-health-condition scenarios from routine short-term issues so users can see where the reason itself may be the blocker.
