FMLA public agency and school employer coverage
Why public agencies and schools do not start with the same 50-employee framing as private employers.
A common mistake is treating every employer like a private company for FMLA coverage. Public agencies and elementary or secondary schools usually enter the analysis differently, which is why LeaveCheck changes the employer-coverage explanation when those employer types are selected. That does not mean every later module automatically passes, but it does mean the opening threshold conversation is different. Users still need to check service, hours, and qualifying reason, but they should not use the private-employer 50-employee framing as the first and only gate.
